What is the law on cellphone use while driving in NZ?

7.3A Ban on use of mobile phones while driving

 “(1) A driver must not, while driving a vehicle, create, send, or read a text message on a mobile phone or make, receive, or terminate
 a telephone call on a mobile phone or use a mobile phone in any other way. This sub clause is overridden by sub clauses (2) to (6).
 “(2) An enforcement officer may, while driving a vehicle, use a mobile phone to make, receive, or terminate a telephone call if the officer
   is making, receiving, or terminating the call in the execution of the officer’s duty.
 “(3) A driver may, while driving a vehicle, use a mobile phone if
“(a) the driver is using the phone to make a 111 or *555 call; and
“(b) it is unsafe or impracticable for the driver to stop and park the vehicle to make the call.
“(4) A driver may, while driving a vehicle, use a mobile phone to make, receive, or terminate a telephone call if the phone does
not require the driver to hold or manipulate it to make, receive, or terminate the call.
“(5) A driver may, while driving a vehicle, use a mobile phone to make, receive, or terminate a telephone call if 
“(a) the phone is secured in a mounting fixed to the vehicle; and
“(b) the driver manipulates the phone infrequently and briefly.
“(6) A driver may, while driving a vehicle, use a mobile phone to make, receive, or terminate a telephone call if the vehicle
has stopped for a reason other than the normal starting and stopping of vehicles in a flow of traffic.

What are the penalties?

An infringement fee of $80, and 20 demerit points is the penalty for those breaching a ban on using cellphones while driving.

Why should I use hands free technology?

If you want to talk on your cell phone while driving, you must use a hands free device. Research and statistics show that using a cellphone while driving quadruples the risk of being involved in a crash. As of 1st November 2009, and with certain exceptions, it is illegal to hold your cell phone while driving.

How do I fit a hands-free device?

What about the battery, how long does it last?


Like all battery powered devices, it depends on the amount and frequency of use. Some units have a standby time of 7 days and a talk time of between 4-6 hours. In all cases, the device can be recharged, either in car via a 12volt power cable, removed and recharged via a USB cable on your computer or in some cases by solar power.

Is my mobile compatible?

Generally speaking all new mobiles tend to be bluetooth enabled. If your mobile is older than 1 year it may not be compatible.
